4. Commercial Estimates and Project Proposals Any financial estimates, revenue-sharing models, or acoustic project proposals provided via our website, email, or WhatsApp communication are provisional and valid only for the duration specified within the respective document. The Company reserves the right to adjust material configurations, structural methods, and commercial pricing based on site-specific variables discovered during physical assessments.
5. Client Responsibilities To ensure precise engineering outcomes, clients must provide accurate architectural data, site access for physical assessments, and timely communication. The Company shall not be held liable for compromised acoustic isolation or performance degradation resulting from inaccurate data supplied by the client or third-party contractors deviating from our established structural methods.
6. Limitation of Liability To the maximum extent permitted by applicable Indian law, Estelon Acoustics (OPC) Private Limited and its engineering personnel shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the implementation of our structural advice or acoustic materials. Our total liability for any claim arising out of or relating to our consulting services shall not exceed the total amount paid by the client for that specific service segment.
7. Third-Party Links and Tools Our website utilizes third-party integrations, including automated form processors and WhatsApp communication APIs. The Company is not responsible for the operational uptime, data handling practices, or terms of these third-party platforms.
8. Payment Terms and Non-Refundability Due to the specialized nature of our acoustical engineering services, all fees remitted for physical site assessments, technical data analysis, and the formulation of acoustic blueprints are strictly non-refundable once the engineering process has commenced. Advance payments required to secure project slots or initiate the procurement of structural materials are final. Project-specific payment milestones will be outlined directly within individual commercial estimates.

Corporate Confidentiality and Non-Disclosure We recognize that executing acoustic vulnerability assessments within enterprise and commercial spaces often requires access to sensitive structural or operational data. The Company agrees to maintain strict confidentiality regarding all proprietary client information, speech privacy vulnerabilities, and internal floor plans encountered during our assessments. Conversely, clients agree not to disclose our proprietary engineering matrices or commercial pricing models to competing consulting firms.
10. Force Majeure and Material Logistics The Company shall not be held liable for any delay or failure to perform its obligations under these terms if such delay is caused by circumstances beyond our reasonable control. This includes, but is not limited to, acts of God, governmental restrictions, logistical failures, or sudden supply chain disruptions regarding highly specialized acoustic isolation materials required for project execution.
11. Governing Law and Jurisdiction These Terms of Service and any separate operational agreements whereby we provide you services shall be governed by and construed in accordance with the laws of India. Any legal disputes, claims, or litigation arising out of our services or these terms shall be subject to the exclusive jurisdiction of the competent courts located in Ghaziabad, Uttar Pradesh.
